PLEASE ENSURE YOU READ THESE CONDITIONS PRIOR TO ORDERING & ACCEPTING DELIVERY
The Purchaser acknowledges that the results to be obtained from the use of the products heron are largely dependent upon the purchaser following normal plant growth procedures or normal building guidelines. The Vendor shall not be responsible for any loss or damage arising
out of failure by the purchaser to correctly use the products. Under no circumstances shall the vendor be responsible for any loss or damage arising from the use of the products listed here on in circumstances where the composition of the vendors’ products have been altered in any manner including but not limited to the addition of extra ingredients after the products have left the vendors premises E.g., Composts, Cements, Oxides ETC
Please take care in what you are ordering as we do not offer refunds for incorrect ordering (This includes but is not limited to asking for something but expecting something else) or if you have ordered too much or simply changed your mind, for these reasons all orders are final and refunds will not be offered for these reasons. Refunds will only be offered in accordance to NSW Law.
At managements discretion orders that are cancelled prior to the loading of the truck (Except Special Orders) may be refunded minus a 30% cancellation fee. Alternatively we may offer a store credit valid for 6 months with no cancellation fee.
Why so much? this is because of a variety of factors such as costs of taking orders ie staff, cost of processing payment, cost of refunding payments, loss of sale of the product for example if you have ordered 3 tonne of a material we ensure this is held for you and we will turn other customers away to protect your order. A lost spot for delivery is also a factor especially when cancelling less than 48 hours out.
If an order has been loaded an additional restocking fee of $30 will be charged regardless of order size. Trucks that are returned for any reason will forfeit the delivery charge plus a return charge of 25% or $50 whichever is greater, in addition to the above mentioned cancellation fees. This is due to most deliveries that are returned are the result of drivers being onsite for extended periods of time without the delivery being effected, missed orders and the fact that delivery costs never cover the actual cost of delivery and only contribute to it.
All Special orders are final and no refund is offered.
All complaints or concerns must raised within 5 Working days of the delivery being effected and must be done in writing to accounts@shantana.com.au anything received after the 5 business days will be treated as feedback only.
In the event a refund is authorised we have a very strict procedure to reduce fraud. Our staff will advise you of this procedure if a refund is required, please note there is no flexibility in this procedure under any circumstances
The supplier's responsibility for the delivery of materials will cease at the kerbside of the job address stated overleaf. If it is requested for a vehicle to cross the footpath or to enter upon private property in the course of effecting delivery the receiver of the delivery will provide
safe and adequate access and not withstanding will pay for ALL damage to any public or private property and every injury or wrong which may result therefrom. Shantana does NOT accept any responsibility or liability for any damage. By requesting the delivery be affected in
private property you are acknowledging that you are either in a position to grant access to the property (IE owner) or you have the owner's
consent to allow access to the private property. Drivers are instructed to assess all areas prior to tipping or unloading, please note drivers must adhere to a strict WH&S policy and if the driver does not feel it is safe to tip in the location of your choice you must select a safer
position for the delivery of goods. If you are not satisfied with this than the driver will return to the yard and you will forfeit your delivery charge and also be charged an additional delivery charge. If a driver agrees to tip in a location selected by the customer and is unable to get out, the customer MUST make arrangements for the safe removal of the truck including any fees.
If drivers are made to wait longer than 15 minutes the customer will be charged for the delay at $10 per 10-minute block to be paid prior to delivery being affected.
All goods remain the Property of the vendor until full payment has been made. For cash on delivery orders drivers are instructed to obtain payment prior to unloading, you are welcome to inspect the load in the truck prior to tipping however drivers will not tip prior to payment, please do not be offended by this.
For payments made via Credit Card over the phone you declare that you are either the primary card holder or you have the express consent of the primary card holder of the card mentioned over leaf to make payment for the goods mentioned overleaf. In the event that the bank of the Card holder successfully disputes this payment you herby acknowledge that the goods will become unpaid for and you accept full responsibility for payment of these goods to fall due by COB of the next business day.
If you are accepting this delivery on behalf of an account customer, you declare that you are authorised by the account holder to accept the product on their behalf, if it is found you are not authorised you will be personally responsible for the payment of the goods at the Recommended retail price.
Delivery Acceptance:
I acknowledge that I am authorised to receive the goods ordered and acknowledge receipt of the goods are as per ordered overleaf I also accept the delivery conditions listed above and acknowledge by responsibilities and liabilities in relation to the effecting of the delivery.
If you are unable to accept or refuse to accept these conditions and insist on the truck be returned no refund will be available plus a return charge may be applied.
