These Terms & Conditions (“Terms”) govern your use of our website and the purchase of products from Shantana Landscape & Building Supplies (“Shantana”, “we”, “us” or “our”). By accessing our website or placing an order, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our website, placing an order, or accepting delivery, you acknowledge that you have read, understood, and agree to these Terms, our Privacy Policy, Delivery & Shipping Policy, and Refunds, Returns and Order Cancellations Policy.

2. Ordering and Acceptance of Orders

All orders are subject to acceptance by us.

We reserve the right to refuse or cancel any order at our discretion (for example, due to pricing errors, stock unavailability, or suspected fraud).

An order is accepted when we confirm it in writing (email) or when we commence processing/loading the order.

You are responsible for ensuring all order details (products, quantities, delivery address, and specifications) are correct before confirming.

3. Prices and Payment

All prices are in Australian Dollars (AUD) and include GST when quoting retail customers and excluding when quoting business customers, unless otherwise stated.

Prices are subject to change without notice. The price at the time of order confirmation applies.

Payment is required as follows:

For account customers: in accordance with your agreed trading terms.

For cash-on-delivery or new customers: payment is required before or at the time of delivery/loading.

We accept payment by the methods shown at checkout or as agreed.

Goods remain our property until full payment is received. Risk in the goods passes to you upon delivery (or collection) in accordance with our Delivery & Shipping Policy.

If a payment is disputed or reversed after goods have been delivered, you remain liable for the full amount and we may take recovery action.

4. Title and Risk

Title in the goods does not pass to you until we have received full payment. Risk in the goods passes to you when the goods are delivered to the kerbside (or as otherwise agreed) in accordance with our Delivery & Shipping Policy.

5. Delivery

Delivery is governed by our separate Delivery & Shipping Policy. By placing an order, you agree to the terms set out in that policy, including kerbside delivery only, site access requirements, and driver safety assessments.

6. Returns, Refunds and Cancellations

All returns, refunds and order cancellations are governed by our separate Refunds, Returns and Order Cancellations Policy. Please refer to that policy for full details.

7. Website Use and Accounts

You must not use our website for any unlawful purpose or in a way that interferes with its operation.

If you create an account, you are responsible for maintaining the confidentiality of your login details.

We may suspend or terminate accounts at our discretion.

All content on this website (text, images, logos, calculators, etc.) is our property or licensed to us. You may not copy, reproduce or distribute it without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law (including the Australian Consumer Law):

We are not liable for any indirect, incidental, special or consequential loss or damage arising from the use of our products or website.

Our total liability for any claim is limited to the price paid for the relevant goods or services.

We are not responsible for loss or damage arising from:

Incorrect use or application of products

Failure to follow normal landscaping or building guidelines

Alteration of products after they leave our premises

Site-specific conditions, weather, or environmental factors

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

10. Changes to These Terms

We may update these Terms from time to time. The current version will be published on our website. Continued use of the website or placement of orders after changes constitutes acceptance of the updated Terms.
